As you are going to list a trademark for sale, we will have to verify you are legally in a position to sell that mark. You will only have to verify the account once.

You will need to prove that you are either the individual, business or organisation listed at the IPO as the owner. If it is a business or organisation, you will need to show you have the legal authority to sell the trademark on behalf of the business – either as a director or owner of that entity or as an individual empowered by your position to list it.

In all cases any documentation provided must show the correct name and address of the trademark owner as listed at the relevant IPO. What you need to provide depends on what role you have.

You will need to provide this before you are able to list any trademarks for sale:

  • If you are a trademark attorney or legal representative of the trademark owner, you will need to be the agent listed on the relevant trade mark register. You will also need to provide us with a signed document from the owner that you are able to sell the listed mark(s) on their behalf.
  • If you are acting as a member of a corporate entity, you will need to prove you are either a principal of the business (director or company secretary), or that you are in a position of responsibility for the marks (Head of Legal or similar). If that power has been devolved to you, you will also need to provide us with a signed document from a company principal or one in a position of responsibility that you are able to sell the listed mark(s) on behalf of the business.
  • If you are an individual, you must provide proof of identity and your connection with the address for service of the trade mark
  • If you are a liquidator, you must provide documentation you are acting as an appointed liquidator for the company who owns the marks.
